It seems my summary of custody/visitation murders for 2013 was premature.

Yet another obviously crazy @$$ father who was apparently awarded his "rights"--even though he was clearly delusional. What family court judge was responsible for this latest disaster?

An Arizona man confessed to killing his teenage son with an ax on New Year’s Eve because he thought the boy was a demon, police said.

Investigators said 51-year-old Gary Sherrill, of Phoenix, was afraid of his son, David, and believed the boy was going to eat him.

The teen’s mother asked police to check on the boy Tuesday because her ex-husband had not returned him, as scheduled, and she hadn’t been able to reach either of them by phone.

Sherrill initially told police the boy wasn’t home, but police persuaded him to invite them into the house.

“Once inside, they located the 13-year-old male victim, David Sherrill, deceased with obvious signs of trauma,” Martos said. “Sadly, the victim sustained stab wounds and lacerations to several parts of his body.”

Police interviewed Sherrill, and detectives said he admitted to killing his son.

Sherrill was arrested and charged with first-degree murder.

Yet another control freak father with a history of domestic violence who slaughtered the kids--all because he was pissed off that Mom was leaving him.

Contrary to the "nice guy" delusions of the neighbor, there were all kinds of red flags here. Men with histories of domestic violence who have also made suicide threats are at VERY HIGH RISK for this kind of crime. How or why a man like this had access to the kids when the mother was not present is not explained. But once again, we see why fathers like ALEJANDRO GALLARDO should not be allowed any contact with the children following the break up with the mother.

Notice that this is the same area where DAVID SHERRILL just murdered his son with an axe during his custody/visitation time.

Stop giving abuser dads access, stop the slaughter of kids.

Slayings in Tolleson, Phoenix leave 4 dead in violent start to new year

Two sisters were found dead in a Tolleson home on Wednesday after police said they were slain by their father in a murder-suicide. Meanwhile, police in Phoenix arrested a father on suspicion of first-degree murder. Authorities said they believe he killed his 13-year-old son with an ax on Tuesday.

The tragic deaths combined to send the Valley violently into the new year.

The scene in Tolleson was discovered by a teenager who visited the home of relatives on Wednesday morning and found a man and his 6- and 8-year-old daughters dead inside.

Two men who were working at a nearby church and food bank said they knew that something awful had happened, and that it was too late to help when they spotted the teenager on the front porch, wailing in agony.

“It was terrified screaming. She was screaming in Spanish, over and over again,” said Steve Haltom, who works at the Bridge Community Church and Tolleson Food Bank.

Dennis Sims, who also works at the food bank, said he wished there was something he could have done to help the teen. He said an older woman quickly arrived and appeared to take control.

“People were devastated by what happened,” Sims said.

Tolleson police were called at about 10 a.m. Wednesday and found the bodies.

Authorities obtained a search warrant after a delay of several hours because of difficulties in locating a judge on New Year’s Day, according to Sgt. Obed Gaytan, a Tolleson police spokesman.

He said detectives concluded that Alejandro Gallardo, 45, shot his daughters to death before turning a handgun on himself. Gallardo shot himself in the head, and the gun was found near his body, Gaytan said. The names of the girls were not released.

“That is the grand question: Why?” Gaytan said.

He said the timing was jarring, with police having the sad duty of notifying relatives who arrived at the scene.

“It is very somber,” Gaytan said. “This is a time when we should be rejoicing with our family. It’s sad this sort of incident happened.”

Neighbors said that there had been arguments between Gallardo and his girlfriend, the children’s mother, and that their relationship was breaking apart.

The neighbors grieved the children’s deaths.

“I just saw them out here playing (on Tuesday),” neighbor Cynthia Echeverria said. “To hear about what happened today was mind-blowing.”

Maria Garza, another neighbor, broke into tears when she heard the news and said through an interpreter that the slain children had played with her children on Tuesday night.

Neighbor Guadalupe Medina said Gallardo was a nice guy who invited neighbors to parties and worked at a nearby warehouse that packages carrots. She said Gallardo had told people that he planned to kill himself because the relationship with his girlfriend was broken but that no one took his statement seriously.

“He never said that he was going to do that to the little girls,” Medina said. “I think he loved them a lot, so he took them with him.”

The Tolleson slayings followed the death of David Sherrill, 13, in Phoenix on Tuesday afternoon.

Police arrested his father, Gary Sherrill, 51, on suspicion of first-degree murder, said Sgt. Steve Martos, a Phoenix police spokesman.

The father told police he was afraid of his son.

“(He) stated he was scared of his son and believed his son was a demon and was going to eat him,” Martos said.

David’s mother asked police to check on her son on Tuesday because her ex-husband was late returning the teen and she hadn’t been able to reach either of them, Martos said.

At about 3:45 p.m. Tuesday, police conducted a welfare check on Gary Sherrill’s residence, in the 6000 block of North 10th Place, Martos said.

Sherrill at first told officers that his son wasn’t home, but officers prodded him into inviting them inside.

A 2-year-old Camden boy is recovering from gunshot wounds and his father is under arrest after telling police he accidentally shot the boy late Tuesday, the Camden County Prosecutor's Office said.

Sergio Rivera, 38, of Camden, allegedly told police he inadvertently shot the child before 10:52 p.m. while in his car at 21st and Pierce Streets. The boy's mother and grandmother were in the car, the Prosecutor's Office said.

Rivera then drove his son to Cooper University Hospital, where the boy was treated for injuries to an arm and a leg. No further information on his condition was available.

Rivera did not cooperate with detectives investigating the shooting, the Prosecutor's Office said.

A 9mm handgun was recovered from Rivera's car. He was found to be in possession of several prescription pills.

Rivera was arrested and charged with possession of a weapon, aggravated assault, endangering the welfare of a child, and related crimes. He was remanded to the county jail on $185,000 cash bail.

"Our prayers are with this child as he recovers," Camden County Police Chief Scott Thomson said in a statement. "Regardless of whether the shooting was intentional or accidental, it's the culture of violence and the illegal possessing of firearms that lies at the heart of our greatest challenge in reducing gun crime."

A San Bernardino man called police early Wednesday morning, telling dispatchers he tried to kill himself after fatally stabbing his ex-wife and 6-year-old daughter.

Police arrived shortly after 5:30 a.m. to find Jordan Sartario, 48, with his wrists slit and his wife and child dead inside a modest green house in the 300 block of 29th Street.

Sartario is accused of stabbing his ex-wife, Miraflor Sartario, 51, following an argument early New Year’s Day, San Bernardino police Lt. Brian Tully said.

The couple’s 6-year-old daughter, Jira, was awakened by her mother’s screams.

That’s when her father turned the knife on the child, stabbing her repeatedly, Tully said.

Police said Sartario attempted suicide, but then called police to report the killing and asking for medical help.

Sartario was taken away by ambulance and hospitalized.

He was scheduled Wednesday to undergo surgery on his wrists. Once he’s released from the hospital, police planned to arrest him on suspicion of two counts of murder.

The couple had been living together in the home for about a year and a half.

Police had no history of domestic violence reported in the home. Sartario has no criminal record in San Bernardino or Riverside counties.

Sartario filed for divorce from a different woman, which was finalized in April, according to court records.

A 16-year-old boy who also lived at the home was spending New Year’s Eve with relatives and was not home at the time of the killings.

The green house with white columns and a shingled roof was surrounded in yellow police tape throughout Wednesday afternoon.

Christmas decorations on the front lawn were in stark contrast to the yellow evidence markers on the front porch.

Erica Hernandez, 39, lived in the home as a roommate, but said she didn’t hear the argument.

She said she awoke to police standing over her, unaware of what had happened to the couple or their child.

Neighbors said they never saw the couple arguing and walked by to see the family smiling and waving.

Veronica Crafton said the couple moved in within the past two years. Crafton said she had planned to introduce her 8-year-old daughter to spunky Jira, who was often seen jumping and hanging on her mom.

“I’m just blown away. It’s so shocking and sad,” Crafton said, with her eyes welling up with tears. “My heart breaks.”

Okay. We get that dad BRYAN FUGATE is a clueless pothead and not the best of parents. But why does HIS mother, the paternal grandmother, now have custody of the kids?

Notice that there is ZERO mention of a mother in the home. If she had been present, wouldn't she have been charged with endangerment too? So what happened to Mom? Is this dude a single father? If so, who was responsible for that decision? Why has the mother been erased from the story?

Father Charged with Endangering Child

SPRINGFIELD -- A Springfield father is charged with endangering children. Police say 32-year-old Bryan Fugate admitted to smoking pot, after he called 9-1-1 for his 23-month old daughter, who he said he thought was having a seizure.

Here's part of the 9-1-1 call.

Caller: Yes, please hurry

Operator: How old is the child.

Caller: She'll be 2 in January.

Operator: Is she breathing.

Caller: heavy sound, huh huh -- We don't know she's, she's choking ... I don't know what to do

The 2 year old tested positive for marijuana in her system. There were two other children at the home when this took place on December 18. They tested negative for marijuana in their system and were placed with their paternal grandmother.

Portage County father indicted in daughter’s death

A 25-year-old Portage County man has been jailed without bond after being charged with involuntary manslaughter, felonious assault and other offenses in connection with the death of his 2½-month-old daughter last summer.

Timothy T. Sullivan, of Maplegrove Drive in the village of Windham, was arrested by sheriff’s deputies Tuesday following a four-month investigation of the incident.

Portage County Sheriff’s Lt. Gregory A. Johnson, commander of the detective bureau, said Sullivan reported waking up on the morning of Aug. 22 and finding his daughter unresponsive inside the family’s apartment.

Johnson said Sullivan, who was unemployed at the time, was alone and caring for the child when he made the emergency call about 11:45 a.m.

Sullivan’s wife, Harley Sullivan, 22, was attending classes that morning at Fortis College’s Ravenna campus, Johnson said.

The infant’s manner of death initially was categorized by the Portage County coroner as “undetermined,” Johnson said. After an investigation by sheriff’s deputies and an autopsy by the Summit County Medical Examiner’s Office, however, the case was ruled a homicide.

“There are indications of suffocation,” Johnson said.

Sullivan, the child’s biological father, also was indicted on one count of reckless homicide, three counts of child endangering and one count of tampering with evidence.

Citing a continuing investigation, Johnson declined to comment on where the child was found inside the apartment when Sullivan reported finding her unresponsive.

The case has been assigned to Common Pleas Judge John Enlow. Sullivan’s next court appearance is pending, Johnson said.

The child’s name was not released.

More on the axe killer dad, GARY SHERRILL. We now find out that this freak had JOINT LEGAL CUSTODY despite OBVIOUS SIGNS OF MENTAL ILLNESS (windows blacked out with tin foil, tight grip on son in public). The fact that this guy was as nutty as a fruit cake was even obvious to the neighbors (who are quite often oblivious as a group). He was even reported to CPS, which, predictably, did nothing.

I find it hard to believe that it wasn't obvious to a family court that Daddy was Bonkers. So who the hell awarded this father joint custody? What hired-hand custody evaluators (court whores) went along with it? We need names and accountability.

A 51-year-old Phoenix, Ariz., man is now facing first degree murder charges after he allegedly hacked his 13-year-old son to death with an ax because he thought the boy was demon possessed and wanted to eat him.

Phoenix police say they made the horrifying discovery on New Year's Eve after the boy's mother called to say she couldn't reach her son, David Sherill, who was staying with her ex-husband, Gary Reagan Sherrill, according to a My FOX Phoenix report.

The report describes the murder scene as "unimaginable" and neighbors say Gary Sherrill was acting strange before he committed the gruesome crime.

"He (Gary) was out in his yard yelling at the tree the day before. So the man apparently had lost it," said Divina Wes, one of Sherrill's neighbors.

Another neighbor, who declined to show her face on camera, said she was rocked with grief because she had reported the father's strange behavior to Child Protective Services and they told her there was nothing they could do for the boy.

"They (Child Protective Services) asked me if I've ever witnessed anything first hand like abuse or neglect, and because I hadn't actually witnessed that they said there was nothing that they could do," said the unidentified neighbor, who said it was Sherill who was the monster inside the family home and not his son.

"I'm heartbroken. I cried a lot last night," she added. "I know that all the windows were blacked out with tin foil. I never saw the child playing. Whenever he was let out of the house he (father) had a tight hold on him, and to be perfectly honest with you, in the beginning I kind-of thought he (boy) was a kidnapped type of person."

Neighbors say when police broke the news to the boy's mother she was inconsolable.

"The mother of the child was down here and crying and screaming and inconsolable obviously," said Divina West.

Divorce records mentioned very little about the father's mental state except: "The father is unemployed and this has likely impacted his mental state..." The records also revealed that the boy's parents had joint legal custody.

Once again, a father with a history of domestic violence and death threats was somehow allowed access to the kids after the mother finally left him. The article does not clarify whether Dad's access was court-ordered, but it apparently was not stopped by the courts either. The results are all too depressing and familiar: two children burned to death.

Stop giving battering fathers custody/visitation rights. Dad is identified as DAE KWON YUN.

Why it took so long for Dad to get to court is not explained either.

Murderer: Dae Kwon Yun has pleaded guilty to killing his two children by setting alight his SUV in 2006

A father has pleaded guilty to murdering his two children after setting his SUV on fire in a murder-suicide attempt - before jumping out of the vehicle and leaving the youngsters to die.

Dae Kwon Yun, 61, will serve two consecutive life sentences without the possibility of parole for the horrific 2006 crime. Prosecutors said they would no longer seek the death penalty.

The sentence comes six years after Yun killed his children in Los Angeles' Garment District just two weeks after he separated from his wife of 13 years and a week after his clothing business closed.

Yun apparently doused the inside of his Toyota Sequoia with fuel before setting it on fire, with his 11-year-old daughter Ashley and 10-year-old son Alexander inside.

A witness, Nelson A. Calderon, testified in 2008 that he had see the father shouting at Ashley before forcing her into the back seat of the car, the Los Angeles Times reported.

When the vehicle caught alight, Calderon added that Yun dropped to the ground with his legs on fire and shouted for help, but never signaled to the children inside the car.

Firefighters found that Alexander's body was positioned inside the car in a way that suggested he was trying to open the door.

Yun, who suffered second- and third-degree burns to his face, hands and legs, is believed to have set the car alight in a murder-suicide bid after gathering debts from gambling and owing $100,000 in back taxes.

His wife, Sun Ok Ma, had left him a fortnight earlier before filing for divorce. She testified that he repeatedly beat her and threatened to kill her and burn down their home.
He had previously pleaded guilty in 2004 to beating Ma, and was sentenced to two years' probation.

As he appeared in court on Tuesday, Yun looked dishevelled and shuffled into court chained and handcuffed at the waist, the L.A. Times reported.

A sheriff's deputy told the judge his status had been changed to 'suicidal'.

He responded to the prosecutor's questions in a low voice through a Korean interpreter.

'He was always mad,' a fellow shop owner, Miriam Sandoval, said after the killings. 'He was one of those people who would never even smile at you.'

Whoa, just a second here. Dad DONALD NELSON is apparently spending the night in his car with his severely battered preschool age son, and eventually Daddy just happens to notice when he starts driving around that the child is not breathing. He calls 911, the boy is taken to the hospital, and the boy is pronounced dead.

Meanwhile, the last line of this article wonders where the father's other children are(!?!).

What I'd like to know is where the mother of these children are, and why it doesn't even occur to the reporters (or the police?) to ask this question. Why does this apparently violent, homeless father have possession of a child this young, and, so it seems, other kids who are supposedly "missing"?

Whenever an abusive father has killed a child and there is no visible mother around, we must ask what happened to the mother. Is she dead? If so, by natural causes? Is she "missing"? If so, do we know that she wasn't driven out of the home by death threats or violence? Was she stripped of custody by this loser? What?

Fresno police: Father faces charges in death of 3-year-old

Fresno police Chief Jerry Dyer said the father of a 3-year-old boy who died Thursday morning is facing charges of at least child abuse and possibly murder.

Detectives are investigating the boy's death in central Fresno, where the child was found not breathing by police Thursday morning. Detective Sgt. Dave Ramos said officers went to Palm and Garland avenues about 8:30 a.m. after the boy's father called 911.

The father reported that he and the boy spent the night in their car and that as he was driving he noticed that the boy, who was wrapped in a blanket, was not breathing. Dyer said when officers arrived they found Donald Nelson holding his son.

Officers performed CPR and the boy was rushed via ambulance to Community Regional Medical Center, where he was pronounced dead about 9 a.m. While the son was taken to the hospital, an officer saw significant injuries to the child and an investigation was launched.

Dyer said police requested an autopsy Thursday to determine the severity of the charges that Nelson will face.

In addition, police are trying to locate another of the father's children.

We posted on this case before many of the facts were available, and even then it suggested a custodial father situation.

Once again, we see what happens when a father with a history of domestic violence gains custody. He immediately shuts off all contact between the mother and the children. The police ignore any evidence of abuse. And then the Daddy eventually goes off for some reason and kills somebody. This one, DONALD NELSON, apparently got all aggrieved because of a toileting accident with his 3-year-old son. So he beat the kid to death.

What judge in Fresno County gave this father custody? Let's see the names.

Let's see the names of the custody evaluators and the usual assorted court whores who aided and abetted this killer. Let's see them held responsible for their screw-ups and corruption.

This is one of those cases where even the (usually clueless) neighbors saw that this guy was a menace. So don't tell me that those in authority couldn't figure it out.

So much for fathers being discriminated against. Once again, we have a violent father who was coddled by the system until somebody was murdered.

Girlfriend of Fresno father also arrested in toddler's murder

FRESNO, Calif. (KFSN) -- The mother of a dead three-year -old says she warned police she had serious concerns about the violent outbursts of the child's father.

Police have also arrested the father of 3-year-old Zion Nelson and his live in girlfriend for the boy's murder.

Investigators say the toddler was beaten all over his body, by his dad, Donald Nelson and Moneesha Camp.

Officers say the suspects coached the victim's 5-year-old brother to lie to police when he was questioned. We want to warn you, details of this story are disturbing.

Since the murder, police say they have heard various versions of what happened from the suspects. But the evidence they found at the apartment, revealed the little boy was fatally beaten with a wire clothes hanger.

Fresno police say neighbors heard yelling and banging between 3:30 and 4:30 Thursday morning. A memorial now sits outside the apartment where neighbors say the couple pretty much stayed inside with two boys.

Investigators say it appears the victim, identified by his mother as Zion Nelson, was given a final beating for wetting his bed.

Fresno Police Chief Jerry Dyer said, "The boys back, buttocks, thighs, arms, chest and stomach were completely covered with injuries from marks, bruises, and cuts."

Police say around 8:30 Thursday morning, Donald Nelson called 9-1-1 to report his son was not breathing. The officer found the naked and lifeless little boy in the back seat of Nelsons car, in a neighborhood blocks from where they live. The child was wrapped only in a blanket. Officers say Nelson originally said he was homeless and they slept in the car, until police learned that was a lie.

Zion's mother says she and Donald Nelson have been involved in a child custody battle.

The victim's mother Tiara Larson said, "Now, I don't even get to see my son. I didn't get to see his last Christmas, his last birthday, nor his last Halloween. And it hurts because Donald took my kids out of spite, because I got into a new relationship, with a new person."

Larson claims she filed for custody in Sacramento County then Donald filed in Fresno County. Donald was granted custody here, even though he was arrested for domestic violence against her.

Police say Larson called last April and requested officers check on the children. At that time, the police chief says the officer who saw the children reported they appeared fine.

But neighbors, who didn't want to talk on camera, say Donald often lost control over the smallest matters. Inside the two bedroom apartment, officers found more than 60 holes in the walls. They also found blood on a bed and the wall.

Chief Dyer said, "The truth is that this incident occurred inside the apartment in the area of Saginaw and Thorne and that is where the beating took place."

Larson is now working to get custody of her 5 year old. Police say he was also abused and is in CPS custody.

JOPLIN, Mo. — A young Joplin father is being held on charges that he shook his 6-week-old daughter, causing her to suffer a brain injury.

Cpl. Chuck Niess, with the Joplin Police Department, said the baby was having seizures when her parents brought her to the emergency room of Freeman Hospital West about 9 a.m. Thursday.

Doctors decided the girl was in serious condition from a shaken-baby injury, and arranged for her transfer by medical helicopter to Children’s Mercy Hospital in Kansas City, Niess said.

The baby’s father, Cody W. Williams, 25, was interviewed by investigators and arrested Thursday afternoon on a felony charge of child abuse.

A probable-cause affidavit filed in Jasper County Circuit Court alleges that Williams admitted shaking the girl inside their home at 114 S. Butler Ave. about 3:30 a.m. Thursday when she would not stop crying. The affidavit states that he was asked by investigators to demonstrate what he had done with a doll and he “violently shook the (doll) more than one time.”

Williams remained in custody late Friday afternoon at the Joplin City Jail. His bond set at $10,000.

With the help of a sibling, a fifteen-year old was able to struggle free from ropes allegedly tied around the teen’s ankles and legs.

The teenager told Utica Police that they he tried to fight back as the father approached with the ropes, but was not able to overpower the father. Rope was then allegedly pulled around the victim’s neck and tightened until the child passed out. Police say they believe the victim was unconscious for about thirty minutes.

The incident occurred on the 900 block of Mary Street on New Year’s Eve.

Following their investigation police have now arrested 32-year old Sar Paw, the teenager’s father. Paw is being charged with second degree strangulation – a felony, and endangering the welfare of a child.

Sioux Mother Rescues Abused Children, Faces Arrest

The emergency room doctor was furious at what he had seen, recalled Audre’y Eby, who is Rosebud Sioux and the mother of disabled 16-year-old twins. One of her sons, who is blind and autistic, squirmed on the examination-room table, screaming, “Ow, ow, it hurts!” The doctor had found livid red and purple bruises covering his penis and scrotum, according to the Nebraska hospital’s records. Those injuries would soon lead to an arrest warrant for the mother—not because she had caused the harm, but because she did not return her son, along with his wheelchair-bound twin, to their abusers.

Indian child welfare expert Frank LaMere called the twins’ situation more extreme than any he’d seen in his many years of work in the field. “These boys are suffering,” said LaMere, who is Winnebago and the director of Four Directions Community Center, in Sioux City, Iowa.

The day before the ER visit, Eby, who is 45, drove from the Nebraska farm where she lives with her husband, Faron, to pick up her boys from their father in Iowa. It was early August of 2013, and she was going to have them for the once-a-month weekend visit the courts allow her. The boys’ father is Eby’s ex-husband; he has physical custody of the kids, and his live-in girlfriend is their primary caretaker. Eby and the boys are Native, and the father and his girlfriend are white—facts that LaMere says overshadow decisions that social-services professionals and the courts make on the children’s behalf.

During the five-hour drive to Nebraska, both twins complained. Eby put the grumbling down to the road trip—a long one for such special-needs kids. The sighted twin has cerebral palsy and can suffer painful muscle spasms, and his brother has residual discomfort from a vehicle accident he was in with his father a few years ago. “We stop for breaks, but it’s a lot of sitting still,” Eby said.

The next day, the blind twin began complaining again, and Eby saw blood in his overnight diaper. Alarmed, she and Faron loaded both boys into their car and headed for the ER. After the exam, at a moment when only health-care personnel were present, the doctor took the opportunity to ask his patient, “Who did this to you?” The child named his father’s girlfriend. The doctor questioned the sighted twin, who confirmed his brother’s story.

The doctor told Eby that the injuries were consistent with being kicked in the groin. He immediately called Nebraska’s Department of Health and Human Services to report alleged child abuse, hospital records show. Eby says the physician also warned her that if she didn’t keep the boys until their wellbeing could be guaranteed in Iowa, he’d have to report her for exposing children to an unsafe situation: “He said Nebraska law required him to do that.”

Eby’s fateful decision to keep her kids in Nebraska soon led to an Iowa judge issuing a warrant for her arrest. She is trapped between the laws of two states and fearful for her sons’ safety.

The Nebraska doctor’s report launched an extensive investigation by Iowa’s Child Protective Services (CPS). The investigation included another physical exam and interviews of social workers, teachers and others who’d interacted with the twins. The boys participated in a Telemed closed-circuit TV interview observed by social-services and law-enforcement personnel in Iowa and Nebraska. (The twins’ names, and that of their father, whose last name they bear, are being withheld to protect the children’s privacy. All official documents quoted here were obtained under Iowa law.)

Both children claimed the kicking occurred after the blind twin was discovered masturbating. He tells the interviewer that his dad had once threatened that “he’s gonna cut my privates off” for doing that. At one point, the boy begs, “Please help me. I’m scared.”

The investigation led to a determination that the father’s girlfriend caused the groin injuries, which means the abuse was “founded.” The father and girlfriend already had several abuse and neglect determinations between them. CPS gave the twins its highest score for risk of abuse and recommended a criminal investigation.

The girlfriend has appealed the most recent abuse finding, according to Iowa Department of Human Services (DHS) documents. No charges appear to have been filed against her. She claimed the boy did the damage to himself and told CPS, “I love the boys and would never do anything to hurt either one of them.”

The father told ICTMN that whatever happened didn’t happen in Iowa and that the couple would appeal more of the abuse and neglect rulings. Over the years, 14 additional allegations have been investigated and dismissed, he noted.

Iowa DHS documents record a startling list of incidents at the father’s home: Among many, the father recently pressed on the wheelchair-bound twin’s nose until it bled, resulting in one of the founded-abuse determinations. On another occasion, the dad poured hot sauce down that boy’s throat while the girlfriend pressed her elbow into his neck to ensure he swallowed it. A social worker recounts watching the father smash a sandwich onto the blind boy’s forehead, purportedly to get him to eat his lunch. The girlfriend has stuffed a cloth down one boy’s throat to silence him. Punishments include cold showers.

Social workers describe quasi-military discipline. “I’m a veteran, and I'm trying to instill values like honor, loyalty and courage in my children,” the father said. “If that’s wrong, then a lot of parents are wrong.”

Judy Yellowbank, who is Winnebago and the program director at Four Directions Community Center, likened the twins’ treatment to torture. She charged that there’s a double standard in child welfare. “Native parents would be behind bars if they had committed the child abuse and neglect that these two white caregivers have,” Yellowbank said.

Following the recent kicking incident and subsequent abuse finding, Iowa DHS recommended returning the twins to their father’s home, with the caveat that the live-in girlfriend no longer be primary caregiver. When asked how that set-up would work from a practical point of view, the father refused to answer.

One of Eby’s attorneys, Judy Freking, of LeMars, Iowa, asked, “What is the purpose of a child-abuse investigation if, upon concluding that abuse occurred, DHS does not get involved, and DHS does not offer any services to correct the problem that led to the abuse of these boys?”

The father is determined to get the kids back, saying Iowa can provide them more services than rural Nebraska, where the Ebys’ farm is. He recently went to Iowa juvenile court, claiming that his ex-wife was keeping the boys in Nebraska because of “extreme hostility” toward his girlfriend. The judge agreed, writing in an order issued this past September, “It’s apparent this animosity has been a factor.” The judge noted the father’s claim that he had “fully and properly cared for the boys.” The order does not mention the founded abuse and neglect rulings or any criminal investigation.

In October, a district court judge issued an arrest warrant for Eby. She learned of it when it pinged into her email from the Iowa courts’ online system. “I couldn’t cry because my sons were here. I called Faron. He came home from work and sat with the boys, so I could get myself together. Faron has been such a powerful support in all this. We both want the boys living on the farm with us.”

After Eby and the boys’ biological father separated in 2003, when the boys were six, she cared for them. When they turned 12, she thought they should get to know their father. “At the time it seemed like a reasonable idea,” Eby recalled. As the problems in the father’s home mounted, she fought to get the boys back, succeeding briefly in 2011. Through all the abuse and neglect findings, Iowa DHS documents reveal, the agency’s goal has generally been to reunite the twins with their father, and the courts have concurred. He receives their social-security and other subsidies.

Attorney Freking wondered if the situation would have played out similarly if Eby had committed the abuse. LaMere has an answer, and it’s simple: No. He said that Eby’s situation is emblematic of the double standard Yellowbank described. Indian parents are expected to leap enormous hurdles to keep their kids—with no second chances and no benefit of the doubt, said LaMere.

“It does appear that Audre’y and her ex-husband aren’t on equal footing in terms of Iowa DHS recommendations to the courts,” said Freking. ) One of Audre’y Eby’s twin sons, who has cerebral palsy, receives stitches in an Iowa emergency room. Patterns in Indian child welfare

Recently, Nebraska Department of Health and Human Services did a home study that confirmed Eby and her husband provide her twins with a good home. However, past turbulence in Eby’s life, including drug involvement as a young woman, may be why Iowa won’t grant her primary custody. “Audre’y has left those problems behind, she’s a good mother, and her home study is positive—but that’s not good enough,” said LaMere. “Many of us Native people have lived tough lives, and as far as the system is concerned, anything we’ve been involved with follows us forever. We are not allowed to grow and change.”

The phenomenon is common in Indian child welfare, LaMere continued. “I see it in meetings I attend with Native parents. The parent has solved the problem that caused the children to be taken away. Perhaps it hasn’t been an issue for years. But that’s never good enough. At one meeting, a social worker announced she’d found dirty dishes in the sink at the Native mother’s home, so she shouldn’t get her kids back. I became unglued. I stressed that the mother didn’t lose her children over dirty dishes, and they couldn’t be kept from her for this reason.”

The problem has its roots in history. Federal policy long supported forcibly assimilating Native people as a way to solve the “Indian problem.” Starting in the late 1800s, Native children were sent to government- and church-run boarding schools, where “Kill the Indian, save the child,” was the mantra. And many did die—of beatings, starvation and disease. Sexual and emotional abuse led others to commit suicide. The pervasive trauma, touching virtually every Indian family, stalks Native communities to this day.

During the mid-20th century, boarding schools were closed or turned over to the tribes, and the Indian Adoption Project took over as the assimilation mechanism. This federal program, aided by states and churches, swept about a third of Native children into non-Native homes. After hearing much testimony, Congress passed the Indian Child Welfare Act (ICWA) in 1978 in an effort to stem the social and cultural holocaust.

ICWA established Indian preferences for placement of Indian children like Eby’s sons, whether they are enrolled tribal members or eligible for enrollment. ICWA allows tribes to intervene on behalf of their children and requires “active” efforts keep Indian kids with Indian families. “Legally, that means more than ‘reasonable’ efforts,” said LaMere. “It means busting your butt to make it happen.”

In the real lives of Native people, it just doesn’t work out that way. “If you’re having any problems with the system, they’ll take your kids anytime they want,” said a Santee Sioux grandfather, whose granddaughter and grandniece died after being adopted out of his family—one at the hands of her new father and the other by drowning.

ICWA may be federal law, but its enforcement takes place county by county, according to LaMere. He described progress in applying the law in one Iowa jurisdiction—Woodbury County, with its large Native population centered in Sioux City. “I have to believe that if Audre’y’s case had been dealt with here, she would have gotten custody of her sons. However, in other parts of Iowa, and in many states, old attitudes persist about Native people.” There’s a sometimes unspoken and sometimes openly acknowledged belief that American Indians can’t or shouldn’t take care of their kids, LaMere said. Neither the Iowa DHS Native Unit, which oversees Native-related cases, nor the Rosebud Sioux Tribe responded to requests for an interview about these issues.

The Iowa courts’ seeming inability to deal even-handedly with Native people causes ambiguities for other agencies, including law enforcement. In a phone interview, local Iowa police chief Dan Kremer, who observed the CPS Telemed interviews related to the blind twin’s ER visit, said at first that some were “out to hang” the father and his girlfriend. “Maybe they need hanging,” Kremer then added, “but so far the courts have not gone after them.” He pointed out that the situation in the home “has been going on for a long time.”

Looking forward

Since the twins have been on the Nebraska farm, they’ve put weight on their once-emaciated frames, and Eby has let their crewcuts grow out. “They look so handsome now!” she said. The other day, she recalled, one son told her, “I don’t feel shrunken any more.” She enjoys seeing them caught up in the rhythms of farm life. “Family comes to visit. We have real sit-down dinners with no TV, and Faron makes root beer floats on Saturday nights.”

Eby called LaMere a critical ally. “He says to focus on the good, pray and be mindful of what we have. I don’t think I’ll ever be able to express the pain of all this, but the love I can.”

LaMere sees a lesson: “The Creator sent us these two boys as teachers—to instruct us to renew our fight to keep our kids safe and our families intact.”

For Eby’s family, the future is uncertain. “Something will change, but I don't know what,” she said. “Somehow, life has to be bearable for my boys. Is there anything else I can do?”

Let's ask our usual questions, the ones the authorities always fail to ask. Is the mother deceased? If she is, do we know for a fact that it was a natural death? Is she "missing"? If so, was she driven out of the home by death threats and/or violence? Did the abusive father strip her of custody through the family courts in order to "punish" her? These are always important questions to ask when we have a violent father who has managed to gain possession of a child, only to harm that child.

The father and stepmother of a 4-year-old boy were charged with cruelty and injuries to children on Friday after a Dec. 11 incident that result in “significant permanent damage” to the child, according to a Suffolk spokesperson.

Bernard Olonzo Esannason, 30, and Vallerie Maria Esannason, 33, were charged at Western Tidewater Regional Jail, where they already were being held on aggravated malicious wounding charges, according to Suffolk spokeswoman Diana Klink.

Referring to HIPAA health privacy regulations on Monday, Klink refused to elaborate on the charges, the alleged abuse, the reason for the delay between the first and second set of charges, the extent or type of the child’s injuries or the current health of the child.

Both suspects are being held at WTRJ without bond.

An Omaha father has been cited for 3 counts of child neglect after police find his children living in a dirty home.

An employee of the Nebraska Department of Health and Human Services alerted Omaha police to the home near 49th & Hamilton in late December.

When police stopped by, they found food, clothes and vomit on the floor in the living room area. In the bathroom and second bedroom there were more clothes & food reportedly on the floor.

Police also noted the oldest child was sick with a runny nose and that her hair was stuck in the mucous running from her nose.

The middle child was reportedly without clothing to wear. According to the police report, officers took about 10 minutes to find a pair of pants and a shirt for her to wear, and the clothing was dirty.

The father was cited for 3 counts of child neglect.

I saw a news item on this yesterday, but held off on posting it till there was more information. Though the police are gauging their comments carefully, this is obviously a murder-suicide. All the classic red flags are there: 1) Father with a history of domestic violence who just broke up with the mother, AND 2) A looming "custody battle" on Daddy's part for control of the child.

A man and a child are dead on the Northshore.

Police say a woman found her two-year-old girl and the child's father dead in the house on Carnation Street near Abita Springs.

It happened in the Abita Nursery subdivision this morning in St. Tammany Parish.

Sheriff Jack Strain says both the girl and the father died from apparent gunshot wounds.

He says they are currently working the case as "a double homicide."

Strain noted, however, until they get more information; "it is still quite possible it was a murder-suicide."

The coroner is conducting autopsies.

The sheriff says the parents were in the middle of a custody dispute and noted there have been domestic violence and mental health calls to the home.

BARTOW | A 23-year-old Lakeland man was sentenced this morning to about 19 months in prison for abusing his 3-month-old son.

Jeremy Richard Miller was arrested in September 2012 after his son suffered a skull fracture and bleeding in his brain.

Police say Miller reported that his son hit his head on a door and then again at a changing table.

Under further questioning, Miller told officers that he was rocking his son when he hit him on his head, according to police.

Miller accepted a plea deal this morning with prosecutors to resolve his case. He pleaded no contest to child abuse.

Circuit Judge Catherine Combee ordered Miller to serve 3 years of probation following his prison sentence.

As conditions of his probation, Miller must undergo a mental health evaluation and follow any recommended treatment. He must also complete an anger management course.

ISSAQUAH, Wash. -- A 37-year-old Issaquah man has been arrested after doctors determined his 6-week-old son's skull fractures were caused by abuse, according to the Issaquah Police Department.

According to police, James Sells and his wife brought their infant to Swedish Hospital in Issaquah Jan. 3 with a serious head injury. The baby was transported to Children's Hospital, where doctors treated it for two skull fractures, brain swelling and bruising.

After doctors determined the injuries were caused by abuse, a social worker at the hospital called authorities, according to police.

Sells was arrested Monday and booked into King County Jail for investigation of assault of a child, and the couple's other children were taken into protective custody and are now living with a family member.

The infant has since been released from Children's Hospital.

FRESNO, Calif. (KFSN) -- A mother is fighting for custody of her surviving son while the father tearfully said he's not guilty of murdering their younger child.

Donald Nelson and his girlfriend Moneesha Camp are charged with murdering Nelson's three-year-old son last week.

Nelson actually had to make two court appearances Tuesday and he cried at both of them. But these weren't his first trips to the courthouse, leaving many to wonder why he even had two little boys in his care.

Donald Nelson's face betrayed some concern as police found his three-year-old son Zion naked and lifeless in the back seat of his car Thursday.

Five days later, his face looked straight down, his eyes filled with tears, and he openly wept as he pleaded not guilty to murdering the boy.

"I've never had a client who was so upset, who cried so deeply, I was just moved by his reaction to the charges today," said Nelson's public defender, Margarita Martinez-Baly.

A judge wouldn't let Action News record Nelson and Moneesha Camp as they entered their pleas Tuesday.

Minutes after the criminal hearing, Nelson moved to another courtroom where Zion's mother is fighting for custody of their surviving five-year-old son.

"It was emotional," said Tiara Larson. "He was, you know, acting like he was sorry. He told me, you know, to take care of him if he gets placed with me."

Larson won the right to bury her younger son, but she'll have to wait at least one more day before CPS allows her to take the older boy out of foster care.

Larson says she tried to warn the agency about Nelson's propensity to violence -- she even asked for and got a welfare check last April, but agents decided the kids were okay.

Police say Nelson coached the boys to lie about abuse in their home. But Nelson also had a verifiable history of violence, including convictions for battery in 2009 and spousal abuse in 2010. The abuse victim was Larson and even though Zion wasn't born at the time, it may have been the boy's first exposure to violence.

"He beat me up, spent only two weeks in jail even though I was pregnant with bruises all over me and got three years misdemeanor probation," Larson said.

"Were you pregnant with Zion at the time?" an Action News reporter asked.

"Yes," she replied. "And they ordered him then, no contact with me or the child and yet just a year and a half later, they gave him custody of the child."

Camp was also in tears in court Tuesday afternoon, but she was a little more composed and she was obviously avoiding eye contact with Nelson.

They both face life in prison if they're convicted.
