Dad in "custody battle" murders 5-year-old son during first unsupervised visitation (New York, New York)

This is what happens when the "rights" of abusive fathers overrule the rights of everybody else. Dad DMITRY KANARIKOV had a history of domestic violence and had threatened suicide over the breakup of the marriage. He was intent on destroying the mother financially. Things were so unsafe that a "neutral place" was designated for the first child exchange. All these are huge red flags--all were ignored by the family courts. We need to listen to the mother's intuition. She sensed that this wasn't safe and it wasn't.

Mom of toddler thrown from NYC building heartbroken

8:23 AM, December 24, 2013
by USA TODAY

NEW YORK (AP) - The mother of a 3-year-old thrown to his death from a 52-story apartment building said the father killed the boy - and then himself - out of spite.

Svetlana Kanarikov said in a statement that she had been nervous about her son's visits with his father, and she initially wanted them to be supervised. But she relented after a Dec. 5 court appearance.

"The father never did anything violent against the child before," Kanarikov said of the two previous visits in a statement issued Monday night through a lawyer. "Both times, Kirill was happy after seeing his dad. Skype calls were also going well."

But police said Dmitriy Kanarikov threw the child from the rooftop of the building before jumping to his own death Sunday.

He had picked up Kirill at 10 a.m. Sunday at a Manhattan police precinct - a neutral site negotiated in advance by the parents - to spend time with him for the first time unsupervised.

The couple had been married four years and separated in August, and Svetlana Kanarikov said she had taken action after a domestic violence incident. Their split was acrimonious. In addition to Kirill, Dmitriy Kanarikov had wanted their house and other property, too, Svetlana Kanarikov said.

"He said he would take the child away and I will 'shoot myself from grief,'" she said. "This was his sick way to take Kirill away from me."

She said he had told his parents that he was taking the child to Grand Central Station but instead went to the building on the Upper West Side and killed himself and the child.

Officers responding to an emergency call reporting two jumpers from the building near Columbus Circle and Lincoln Center found Kanarikov, 35, of Brooklyn, and the boy on the lower rooftops of two separate nearby buildings.

The man was pronounced dead at the scene and his son, Kirill Kanarikov, was pronounced dead at a hospital, police said. A witness said the boy was wearing Christmas pajamas.

"Kirill was a very sweet, wonderful child, who was loved very much," his mother said. "He will forever live on in my heart."

Once again, we have a control-freak dad who was intent on full possession of the child--only to severely abuse him. Poor Mom hadn't seen the boy in five years, but she still faces a big fight getting custody.

Fathers rights in action, folks. Whether it's in New York City or Jakarta, too many of these batterers and criminals are getting their hands on the kids, only to kill them or nearly kill them.

Dad is identified as SURYA ATMAJA GINTING.

Arrests Follow Abuse of 6-Year-Old

By Jakarta Globe on 7:15 am December 24, 2013.

A 6-year-old boy, found gravely injured at an oil plantation in Riau after being abused by his own father and stepmother, was reunited with his mother on Monday.

Devi Andriani, the birth mother of Raditya Atmaja Ginting, or “Adit,” burst into tears when she saw her son laying on a hospital bed in the Bangkinang general hospital in Riau.

Devi who lives in Medan, North Sumatra, separated from her son and his father, Surya Atmaja Ginting five years ago .

She claims her ex-husband took Adit away without her consent after he divorced her.

But Arist Merdeka Sirait, chairman of the National Commission for Child Protection (Komnas Anak) suggested the mother waits until Adit fully recovered before taking him home.

“We appreciate the mother’s intention to take the boy home but we believe there should be an assessment to determine if she is fit to be a parent, or whether she has the same tendency towards child abuse,” he said on Monday.

Arist said Adit’s physical condition has been improving gradually but the boy had been severely traumatized by what had happened to him. Arist added that Komnas Anak has been urging the police to solve the case.

Adit was found by a vegetable seller at a Riau plantation on Dec.15.

Local residents rushed him to a nearby hospital where doctors discovered that the boy had been assaulted with sharp and blunt objects. Adit allegedly told medical staff that his stepmother abandoned him after his ordeal.

Both his father and stepmother Ervina were subsequently arrested and named suspects in a case of child abuse.

Ervina claimed she started beating her stepson because he was a naughty child who often refused to listen to her. She faces 10 years in prison for allegedly violating the 2004 law on domestic abuse, while Surya might face a third of the maximum possible sentence for being an accomplice.

Komnas Anak reported 2,637 instances of domestic abuse against children in 2012. Pitoyo Susanto, a child protection specialist with the Christian humanitarian group World Vision, said child abuse is severely under-reported nationwide due to the popular view that abuse is best resolved within the family.

In local media, abuse victims, their families and supporters have reported threats and intimidation from perpetrators’ friends and family during court trials.

Domestic abuse can be reported at district police units for women and children. Abuse can also be reported at hospitals or centers run by the non-profit organization, the Child Protection Institute.

However, World Vision’s Susanto says many families live far from reporting centers and health providers capable of offering good life-saving medical and psychological care.

Glendale man pleads not guilty in child abuse case

PHOENIX (AP) - A Glendale man accused of child abuse for allegedly trying to throw his 8-year-old son out a window has pleaded not guilty in the case.

Maricopa County prosecutors say Brenden Fairbanks entered his plea Monday. His next court date is on Feb. 6.

Fairbanks was arrested earlier this month on suspicion of endangerment, resisting arrest and aggravated assault on an officer.

The charges stem from an emergency call officers received on Dec. 5.

When officers arrived, Fairbanks was seen inside an apartment with his son. Officers say he grabbed the child and lunged toward a bedroom window, causing it to break.

Officers used a stun gun on Fairbanks because he continued to resist arrest. At one point, he's accused of jabbing a pen into the side of one officer's vest.

Yet another control-freak daddy who just couldn't stand losing power over Mom. Just so angry, don't you know. So he attempted to murder their sons by burning them to death. They survived--but with significant injuries.

Hope prevails after horror attack

December 23, 2013, 6:19 pm

Jackie Quist Today Tonight

Just over a year ago Fletcher and Spencer suffered horrific burns after being set on fire by their own father – innocent victims of an unspeakable revenge attack. Yet these special little boys won't be beaten.

Today, Paul Brian Edward Connelly was jailed for 20 years, to serve a minimum of 15, guilty on two counts of attempted murder.

But mum Alison Lander will not be beaten. Her loving bond with nine-year-old Fletcher and five-year-old Spencer is obvious – and it is no wonder given what they have endured the past year.

Fletcher has burns to 23 per cent of his body; Spencer had burns to 37 per cent of his body, including full thickness burns to his shoulders and neck.

These two very special boys survived an horrific attack inflicted on them by their own father.

Spencer and Fletcher are the innocent victims of Paul Brian Connelly, a man who refused to accept his marriage to Alison was over and, on December 6 of last year, tried to murder his own sons.

“I have to see this every day,” said Alison. “Their scars might be on the outside but mine are on the inside.

“This is a man I was married to for 13 years. The father of my children. I thought he loved his children and I trusted him to have those boys and he betrayed that trust.

“They worshipped the ground their father walked on. They often told their dad that they loved him and he would reciprocate, say he loved them too.”

Forensic psychologist Ian Joblin has assessed over a dozen dads who have harmed or killed their own children over his 36 years in practise.

“They do seem like everyday dads,” he said.

“They will present ordinarily as if there's nothing wrong but when the high emotion involved with separation typically happens, then they will flip into this other persona.

“I don't think there is a name for it but it certainly and unfortunately seems to be a developing trend in serious crime.

“The children are used as instruments of revenge and that means that the father often does not take on any remorse, to the mother of the children it’s like ‘look what you made me do’, as if its your fault, not my fault. He is offloading his guilt from himself onto her.”

Alison had tried to save the marriage, been to counselling. From her point of view it was irreparable.

It was just three weeks before Christmas when Alison set off in search of a new home for her and the boys.

What Alison did not know was the soon-to-be ex-husband she had left behind had already hatched a plot so evil and so twisted it almost defies comprehension.

“It is not easy to think about it and I don’t like to think about it quite honestly. I struggle to talk about it,” Alison bravely admits.

“I know on the Wednesday he picked both children up from school and daycare and went home.

“He had been to the supermarket and bought lots of what we label as junk-food lollies and had those in the car. He got their favourite toys and gave them to them in the car.

“Both children were still in the car and he set the car on fire.”

It was a miracle they survived.

“Fletcher tells me the story of getting himself out of the care,” says Alison.

“When I first saw him in the hospital in emergency he tells me he dropped and rolled and that was thanks to the fire brigade visiting the school a week before.

“The boys spent months recovering in hospital. Spencer had a month in intensive care and 15 operations and will require further surgeries.

He has burns to his knees, hands, arms, neck, shoulders, face and head. The tips of his fingers on his left hand had to be amputated to the first knuckle.

Spencer, though, has not lost his sense of fun.

His older brother, Fletcher, though, understands exactly what happened that fateful day and knows why his looks are affected.

“He has struggled with it. He is very self-conscious about it and wears a hat in public all the time because he has a bald spot,” adds Alison. Fletcher and Spencer are on the long road to recovery.

Family friend Mark Whittle is heading a community effort to support the family going ahead.

He said: “Well I know there are a lot of very worthy causes but I think this one is very worthy and certainly has touched the hearts of people, knowing the boys were so young.

“The boys are going to need support through the ensuing years right through teenage years to adulthood and so it would be great if we can still have money being raised and donated .”

While the community rallied, Paul Connelly inflicted further pain from behind bars when he pleaded not guilty to attempted murder, claiming the explosion was an accident, and stood trial.

After a week-long court case the jury took just one hour to find Connelly guilty and today he was sentenced to 20 years jail with a 15 year minimum.

“His not guilty plea meant that a nine-year-old had to testify against his father,” says Alison.

“I hated it, absolutely hated it that a child should have to go to court. Who would put a child through that? “I don’t think any sentence is long enough.

“He has inflicted a life sentence on them. They’re going to grow up and look in the mirror every day and see what he’s done.

“The good thing is he’s got them too. He got burnt too. I hope there are mirrors in that prison so he can see the scars on him.

“He was angry, he was angry at me. It had nothing to do with those boys.”

Today, at an ordinary house on an ordinary suburban street, there is no evidence of the horror that occurred.

Alison and her boys have moved on, justice has been served and their future is looking bright.

“I've learnt that there are a lot of beautiful and lovely people out there.”

Really, this was nothing short of torture of the worst kind. Yet the authorities are often afraid to label it as such when the torturer is the father or partner of the victims.

This waste of so-called human being is identified as LAO JIN.

The truly scary part? This sh**head also has a "mental health counseling background." Wonder how many other people he as f***ed up over the years.

Sheboygan father's abuse brings prison term

40-year-old gets 30 years for 'environment of fear'

Lao Jin sentenced 30-years for abuse to his family: Lao Jin sentenced 30-years for abuse to his family that happened over a 10-year period.

Written by Josh Lintereur
Gannett Wisconsin Media

SHEBOYGAN — A judge on Friday sentenced 40-year-old Lao Jin to 30 years in prison for subjecting his wife and five children to more than a decade of horrific abuse and mental torment.

In issuing the sentence, Judge Timothy Van Akkeren said the case was unlike anything he’d seen in 24 years on the bench, pointing to the depraved ways in which Jin used his mental health counseling background to terrorize his family.

Van Akkeren said that Jin’s long list of offenses — which included locking one child in a wooden box, driving skewers under another child’s fingernails, dumping a bucket of urine on one child’s head and regularly threatening to kill them — called for “very strong response” from the court that gives his family time to recover.

“The defendant has taken so much from the lives of so many,” Van Akkeren said. “He’s sentenced them to a life of having to live with what he’s put them through, and it’s something that will be extremely difficult for them to overcome.”

Jin’s prison sentence was 10 years longer than what the state recommended. It will be followed by 28 years of extended supervision, which would place him under the watch of the state corrections system until he’s in his mid-90s.

The 2½-hour sentencing hearing was held before a courtroom packed with more than 50 of the victims’ friends and family.

Assistant District Attorney Joel Urmanski recounted abuse that began when Jin’s children weren’t yet school age and how the worst of it happened while his wife was away.

One child had a dog shock collar placed around his neck and was later hung by a nail in the basement with his arms tied above his head.

The kids were also regularly beaten with a bamboo rod, choked and punched and kicked.

Urmanski said Jin once sprayed a high pressure hose into his son’s mouth. On another occasion, he cut his son’s hands with a knife.

The abuse would come with little warning or provocation, and occurred almost daily, Urmanski said.

Meanwhile, the abuse often went a step further, Urmanski said, as Jin would play with his kid’s minds, insulting them, writing derogatory words on their faces with a marker and then pitting them against one another.

Almost missed this story in the month's festivities and general busyness. Dad OREN LEWIS had gained custody "a little more than a month" before this girl's murder (not "tragedy", which is a literary term). Oh no, this wasn't some tragedy handed down from the Gods on High.

Nope, some nitwit judge thought it was a dandy idea to give a father who had never been married to the child's mother custody of a toddler. And then the piece of sh** shows his true colors by bashing her head in. Just another control freak abuser dad, despite all the crap below on what a great dad he was, blah blah.

She fell out of bed? My @$$. Sounds like a lying SOB too.

Who was the judge who gave this idiot custody of a girl who was scarcely older than a baby?

Toddler's father charged with murder 4 months after death

By Al Showers

Updated: 12/10/2013 1:53 am EST

A Waveland man is in jail charged with capital murder in the death of his daughter. The arrest of 31-year-old Oren Lewis comes four months after the little girl died from massive head trauma.

Authorities say they have been working hard to uncover just what happened to 23-month-old Maleah Bush on the night of August 25th.

Oren Lewis surrendered quietly at his home Monday morning, four months after his daughter died in his care.

"This is a very serious allegation to make against anybody," said Waveland Police Chief David Allen. "We wanted to look at the totality of the evidence, talk to the experts, get their reports, look at the scene, interviews, and do a slow thorough methodical investigation before we charged him. So we would be sure of what we feel happened."

Police said Lewis told them he was home alone with his four children on the night of August 25, 2013, when Maleah feel from her bed causing the injuries that led to her death.

"We don't believe that's what happened. We don't believe it could have happened that way," said the chief.

Family members said Lewis was awarded custody of the little girl a little more than a month before the tragedy.

"Whenever the kids did something kind of bad, Oren wasn't the type of father to spank them. He would make them go into timeout," said Oren's aunt, Trellis Spencer.

His mother said her son loves children, and has been teaching special needs children in several coast school districts for years.

"You have to have a heart, you have to have patience, love kids and compassion and that was him," said Sharon Lewis.

But Rita Bush said, "The man that I thought I knew, I didn't know."

Rita Bush is Maleah's mother. She and Lewis were not married, and custody of the child ended up in court. Bush said she's been waiting all these months for answers.

"The evidence tells a story. It tells the entire story of what exactly happened to my baby. And I gave him the benefit of the doubt in the beginning. And then once I spoke to the doctors at Children's [Hospital in New Orleans] and all of the medical professionals, the evidence just proves otherwise. It's a sad story. No one could imagine a man killing his own child. But it's true and it's something I have to deal with and he has to deal with," said Bush.

Oren Lewis is being held in the Hancock County Jail on a $1 million bond.

Another story we almost missed this month.

Mom must have had all contact eliminated for this to go on for three long months.

Yet there is no explanation as to why. Was she deceased? "Missing"? Did she lose custody through the courts? If so how and through what judge?

Whenever you see an custodial dad who is this evil, vicious, and controlling, one should always ask why the mother has seemingly "disappeared" from the picture. What ever he doled out to this child he very likely doled out to the mother. So what happened? Silence, as usual.

Dad is identified as ROBERT HOHN.

Why the headline writer considers 6 years a "lengthy" prison sentence I have no idea.

Newark father, stepmother receive lengthy prison sentences for child abuse

Posted On: Friday, December 6th, 2013

Categories: Criminal Department of Justice Family Press Releases

Wilmington – Attorney General Beau Biden today announced that Robert Hohn and Shannon Watterson, a Newark couple, have received multi-year prison sentences for abusing and neglecting one of their children, a 12 year-old son, over a three-month period last fall.

“The lengthy sentences we sought and that were imposed upon these defendants today reflect the significant harm caused by child abuse and neglect and they send a clear message to child abusers that you will face significant consequences for your crimes,” Biden said today.

Hohn, then age 42, and Watterson, then age 40, of the 100 block of Brookside Boulevard in Newark, were arrested on November 28, 2012 by New Castle County Police and charged with child abuse after a police investigation revealed that their son had been physically abused and become malnourished after they locked him in his bedroom for a three-month period, causing serious physical injury by failing to feed him regularly, neglecting to provide medical care, and failing to enroll the child in an adequate educational curriculum. In addition, both were charged with Endangering the Welfare of a Child for committing child abuse and/or assault against the child in the presence of three other children who were living in the home. The police investigation was initiated after the victim escaped from his home and responded to the residence of a neighbor, who contacted police.

This morning, New Castle County Superior Court Judge M. Jane Brady sentenced Shannon Watterson to five years and one month in prison and sentenced Robert Hohn, IV to six years and one month in prison. In addition, Judge Brady ordered both defendants, while incarcerated, to spend 10 days in solitary confinement each year beginning on November 28, the date of their arrest. She also ordered the pair to have no contact with the son who was the victim of their abuse and ordered them to have no contact with the three other children who lived in the household at the time of their arrest unless approved by Family Court.

Hohn and Watterson were indicted on multiple charges in March, 2013 and both pled guilty to one count of Assault 2nd Degree and one count of Endangering the Welfare of a Child in September, 2013. Both defendants have been incarcerated in lieu of $282,500 cash bail since their arrest. Biden reported that his office has closely monitored the welfare of the abused son who, now at 13 years-old, is happy and well cared for. “The vast majority of abused children are victimized by parents or others who have responsibility for their care,” Biden added. “It’s not a child’s responsibility to protect him- or herself, it’s ours and I urge all adults who suspect that a child is being abused or neglected to fulfill their legal and moral duty by contacting the Delaware Child Abuse Hotline at 1-800-292-9582.”

Father Charged With Abusing Child In Columbia County

Posted on: 4:54 pm, December 6, 2013, by Nikki Krize, updated on: 06:34pm, December 6, 2013

CATAWISSA — A father in Columbia County faces several charges after police say he abused his 2-month-old son.

When the child was taken to a hospital in October, investigators say he was covered in bruises and had some fractured bones.

Matthew Sacks, 25, of Locust Township told investigators he did not abuse his son but there may have been a few instances when he was too rough with the infant by accident.

Sacks turned himself in Friday morning and was arraigned in district court in Catawissa.

“I have nothing to say right now,” Sacks said outside district court.

He faces a list of charges including aggravated assault and endangering the welfare of a child. Police say Sacks abused his infant son in October.

According to court papers, the baby was taken to the hospital because he was not eating. Doctors found multiple broken bones and bruises on the baby boy. Police say this is not the first time Sacks is accused of abusing one of his children. In 2008, Sacks admitted to abusing his 4-month-old daughter. Sacks was forced to attend parenting and anger management classes.

He was unable to post bail and was taken to the Columbia County jail. Sacks is scheduled to appear in court later this month.

Nagoya father arrested after second twin baby dies; violence suspected

Dec 6, 2013

NAGOYA – A man from Toyohashi, Aichi Prefecture, was arrested Friday for allegedly inflicting bodily injury resulting in the death of the youngest of his three daughters in July 2012, police said.

Kazuya Suzuki, 33, a company worker from the Nishi Miyuki-cho district, was arrested on suspicion of harming the 7-month-old girl at their home. The victim, named Mirea, was the youngest of twins.

The police allege Suzuki hurt the girl by either vigorously shaking her or slamming her into something, which resulted in several head injuries, including acute subdural hematoma, considered the deadliest of head injuries. The child, who was taken to a hospital after the incident, died the next month.

Suzuki has denied battering or shaking the girl.

The girl’s twin sister, meanwhile, died in July this year, the police said. They are investigating the case based on allegations that she also was subjected to physical abuse.

The police believe both twins died from “shaken baby syndrome” that also resulted in severe brain injury.

Shaken baby syndrome is a form of child abuse caused by forcefully and violently shaking a child’s body. Because an infant’s brain is not fully developed and the violent movement pitches the brain back and forth within the skull, it can destroy brain cells and in extreme cases result in death.

Suzuki’s twins were hospitalized in February 2012 after their health condition had worsened due to cold. The older twin was diagnosed with brain damage during hospitalization in 2012 and was pronounced dead this July after being transferred to a hospital in Hamamatsu, Shizuoka Prefecture. Police speculate that Suzuki might have abused the older twin during her stay in the hospital.

The younger of the two, meanwhile, was released from the hospital after treatment, but she was then taken to a hospital in Toyohashi a second time in July 2012.

Lansing dad guilty in death of infant daughter

6:20 AM, December 6, 2013

By Kevin Grasha

Gannett Michigan

A 38-year-old Lansing man was found guilty late Thursday of first-degree felony murder and first-degree child abuse in the death of his infant daughter.

John Harold Sanders will be sentenced to life in prison without parole. Under state law, that is the mandatory punishment for a first-degree murder conviction. Sentencing is set for Jan. 15, 2014 in Ingham County Circuit Court before Judge William Collette.

According to his own statements to police and others, Sanders was alone with his 3-month-old daughter Ja’Nayjah the morning of Jan. 4 when she suffered violent head injuries and stopped breathing. He never gave an explanation about how she suffered those injuries.

In closing arguments Thursday, Ingham County Assistant Prosecutor Mike Cheltenham said Sanders was tired that morning. He hadn’t been sleeping well. His relationship with Ja’Nayjah’s mother was strained. He was working only sporadically. He was undergoing treatment for long-term marijuana use, and crack cocaine was found in his apartment

“He was at a breaking point,” Cheltenham said.

All those factors taken together, Cheltenham told jurors, help explain why a father would inflict such violence upon his own child.

In his closing arguments, Sanders’ attorney, Joe Ernst, suggested that Ja’Nayjah’s injuries could have been accidental — caused by Sanders as he frantically tried to revive her — or caused by someone else.

Sanders was dating Ja’Nayjah’s mother, 20-year-old Shamarrie Kittle, although their relationship had become strained. They lived together for about a year but Kittle moved out shortly before Christmas 2012. The night of Jan. 3, Kittle brought Ja’Nayjah to Sanders’ apartment.

The following morning, Kittle took a bus to the county health department to fill her infant formula card.

Kittle was at the health department when Sanders sent her a text message, saying Ja’Nayjah had stopped breathing. Sanders called his uncle, who drove him to the hospital. Ja’Nayjah died about 13 hours later. Sanders told several people that he left the infant on a bed to prepare a bottle, and that when he returned she wasn’t breathing.

Ernst raised several possibilities, including that Sanders had, in fact, found Ja’Nayjah not breathing, and “in his best efforts” to revive her, “shook (her) too hard.”

Ernst also placed suspicion on Kittle, asking jurors to consider the possibility that Sanders “could be covering for someone.”

Cheltenham told jurors that all the evidence, including the Sanders’ own statements, show that he was the only person with Ja’Nayjah.

Sanders being responsible for her death, Cheltenham said, is “the (only) explanation that makes sense, based on the evidence…and common sense.”

Report: Dad jailed in toddler's death on Thanksgiving

Chron.com | December 5, 2013 | Updated: December 5, 2013 11:17pm

A Harris County father has been charged, and a week after his son's death on Thanksgiving, he is sitting behind bars, KHOU reported late Thursday.

The TV station says Tremaine Rachal has been charged with injury to a child, but that could be upgraded to murder. His bond is set at $50,000.

Officers tell KHOU that Kaden Perkins, 11 months, was visiting his father and three young half-sisters as the family and other guests celebrated the holiday at a home in the 2300 block of Union Mill Road near Veterans Memorial.

But 911 was later called and the child, who suffered a fractured skull and bruises, was dead when he arrived at the hospital, the report says.

Rachal reportedly told a judge that Kaden fell off the bed. However, that claim was questioned by a doctor who performed the autopsy, KHOU says.

Other relatives are being interviewed as possible witnesses, according to the station, and the three girls who lived in the house were placed with family members.

Man accused of child abuse appeals

KATIE KENNY

Last updated 17:14 05/12/2013

A man accused of turning his garage into a den for child abuse appealed his charges today at the Supreme Court, in a case that will go on to frame the boundaries of child sex offending in New Zealand.

The father, who has name suppression, allegedly forced his 11-year-old son and his son's two friends, aged 11 and 12, to masturbate in front of him. The alleged offences took place in the man's garage where he stored computers, remote control models, a flight simulator and pornography.

Defence lawyer Chris Wilkinson-Smith condemned the man's behaviour as "repugnant", but argued that it was not illegal under New Zealand legislation.

Court documents state the accused would lock the garage doors and show his son and his son's friends pornographic movies. He provided the boys with lubricant, and encouraged them to masturbate, which they "eventually" did. Meanwhile, the man would stand back and watch them.

Wilkinson-Smith argued this was not a breach of the Crimes Act because the man did not touch the boys, or "indulge in any sexual activity" during the incidents.

At the man's trial in the Auckland District Court in January last year, his defence lawyers successfully argued the accused had not committed a crime, with the judge "reluctantly" dismissing the case after ruling the man did not carry out sexual acts "with" the boys. I

In a rare move, the Court of Appeal in October 2012 overturned the acquittal, finding the act criminal because the man had "actively encouraged" the boys to masturbate.

At today's appeal, Wilkinson-Smith said: "While most people would think [the accused's actions] should be criminal, by the state of the law as it's been interpreted, they aren't. The courts can raise the flag and say [the law] needs changing, but that cannot be done during this case."

He said the case was unusual in that it showed you could not charge a man based simply on his misbehaviour, unless those actions aligned with a breach of the law.

In response, the Crown said the law quite clearly targeted the exploitation of children, and "no extension of the law is required to criminalise this conduct".

"If you force someone to masturbate using threats of force you'll be guilty of indecent assault, but if you do the same thing to a child - not needing to use force because the child is respectful of the adult - and there is no criminality, that is quite absurd."

All names are suppressed in the case to avoid identifying the victims. The judges' decision is reserved.

Contrary to fathers rights lies about all those mean, nasty "gatekeeping" mothers out there, many moms are just like this one. Trying to be helpful and accommodating, only to get burned by a sh**head of a father like this one. Sounds like this visit was not court-ordered, but just Mom trying to be nice. And now she's planning a funeral just after the holidays.

Father tries to kill his own daughter in Heilongjiang

Xinhua 2013-12-25 15:51 (GMT+8)

A court in northeastern China's Heilongjiang province has sentenced a man to ten years in prison for attempting to kill his daughter.

Yin Zhihe inserted a needle into his two-month-old daughter's body on Aug. 4 this year, suspecting the girl was not his daughter, the court said on Monday. A DNA test has since confirmed Yin is the biological father of the girl.

The girl was taken to hospital the next day and had the needle removed from her body. Yet Yin inserted three more needles into the girl's body from Aug. 15 to 17. Though all the needles were retrieved during an operation on Aug. 23, they have caused multiple organ injuries and respiratory failure.

The court added that it dispensed leniency to Yin on consideration that he turned himself in to the police and that he didn't succeed in killing the child.

An Aurora man has been accused of endangering the life of his children, after allegedly making them flee a crime scene on foot, in the cold, with stolen drugs.

A warrant has been issued for the arrest of James Hudgins III, 32, 900 block of North Avenue, stemming from a Dec. 17 incident which occurred in Aurora.

Police said Hudgins was involved in a domestic altercation with the mother of his children, and that fight turned physical.

During the scuffle, Hudgins allegedly stole a purse from the woman while pushing her and shoving her.

He was also accused of pushing his 2-year-old child into a counter while fighting with the child’s mother.

When Aurora police were called to the scene, Hudgins allegedly gave his 13-year-old son a bag of stolen drugs, and told him to flee the home.

The teenager and his 10-year-old brother were allegedly forced to walk around in below freezing temperatures and at night to escape police at the request of their father.

Hudgins has been charged with felony theft, felony domestic battery for having a prior domestic battery conviction, and three counts of misdemeanor causing circumstances that endanger the life of a child. A warrant has been issued for his arrest, according to court records.

So this useless dickwad started abusing the baby shortly after birth--punching him, suffocating him, jamming bottles in his mouth, holding him by the neck. He finally manages to kill the baby.

And we supposed to feel sorry for the same dickwad because of his"difficult childhood" and his "various handicaps to being a father"? Oh puleeze. More freaking daddy coddling at its finest. They guy will serve less than 3 years for what he did. Outrageous. And that's not even going into the assaults on the baby's mother.

Dad jailed for punching baby

By GEORGIE BURGESS

Dec. 24, 2013, 1 a.m.

A FATHER who punched his newborn son to stop him crying was yesterday sentenced to 2 1/2 years in prison.

North-West man Simon Adam Johnstone, 25, pleaded guilty to one charge of ill-treating a child and three charges of assault on his partner. The child later died in hospital of injuries, but authorities were unable to establish who inflicted the fatal injuries.

The ill-treatment began in late 2012 shortly after the child's birth, where the father punched the child to stop him crying, held the child around the neck, and also placed his hand over the child's nose and mouth until it could not breathe.

He also shoved the child's bottle down his throat in an attempt to silence him.

A community nurse found a seven centimetre bruise on the child, and Johnstone replied: "I punched him because he wouldn't shut up."

Johnstone strangled his partner while she was holding the baby until she collapsed and dropped him.

Yesterday in Hobart's Supreme Court, Chief Justice Alan Blow took into account Johnstone's difficult childhood, and his various handicaps to being a father. Johnstone's sentence will be backdated from March 2013.

Sorry. Too many of these young sperm donors are too freaking volatile, violent, and unstable to take care of infants. They have zero capacity for empathy and zero patience. This is why we need decent paid maternity care and assholes like this need to get a job to support their family or get out.

Coshocton Father Pleads Guilty to Murder of Infant Son

Updated: Monday, December 23 2013, 09:56 PM EST

COSHOCTON (Ken Hines) -- A man will spend at least 15 years behind bars after pleading guilty to killing his 8-week-old son.

A Coshocton County judge sentenced Corey Lafferty to 15-years-to-life in prison on Monday after the defendant changed his plea to guilty in connection with the murder of his son, Raven, in September, 2012.

The two-month-old boy died days after he was hospitalized with multiple blunt injuries and swelling of the brain.

Lafferty initially claimed his son's injuries were caused by a fall from a swing. The baby's mother, Rachel Santos, was at work when her son was hurt.

"Corey, you took a big chunk of my heart out and stomped on it. This is something that [no] mother should have to go through," Santos said in court on Monday. "What I don't understand is, how can somebody be so heartless and selfish and take the life of a helpless child?"

Prosecutors agreed to drop a charge of child endangering in exchange for Lafferty's guilty plea on the murder count. Lafferty has also been ordered to pay $25,000 in fines and court costs.

Stop giving violent fathers custodial rights, and putting other people at harm's way to accommodate those rights.

Doesn't anybody else have any rights any more? Like to basic safety and security? Or is it All About Daddy All of the Time?

But hey, this is Florida. So it really is All About Daddy All of the Time. No wonder Florida is always a leader on the Killer Dads and Custody list.

A man cut the mother of his child and her new husband with a knife at the Orange Park Mall about 4:20 p.m. Sunday, according to the Clay County Sheriff’s Office.

Lt. Chuck Wolf said a woman and a man suffered injuries during a child exchange between a 28-year-old suspect, a 32-year-old woman and her 27-year-old husband. He said there was a verbal argument that became physical.

The woman’s husband had knife wounds to his face and torso, according to the Sheriff’s Office. The woman was cut on her arm, Wolf said.

The injuries sustained during the incident are not life-threatening, however, both were taken to Orange Park Medical Center, the Sheriff’s Office said.

The suspect, who was detained by Orange Park police officers, is in custody and charges are pending, Wolf said.

The toddler is with the mother at the hospital, according to the Sheriff’s Office said.
